We advised on this extremely complex transaction involving several sponsors to a common project financing. The project had a complex external financing structure, combined with a complex internal financing structure, with various intercompany/intersponsor loans and liabilities as well as a number of ongoing intercompany/intersponsor services and transfers.
We first diligently analysed all interrelations between the sponsors as well as between the individual sponsors and the lender. We then provided for solutions to the situation in the form of a step plan that was discussed and agreed between all sides and featured consensus-orientated negotiations in various constellations.
After reaching such common agreement, we took care of a swift execution of that agreement, being able to save all individual businesses, the common project and a mid-to-long-term recovery for the lender.
The transaction involved legal advice for Austria and Romania.
